Clive Smith Photography (also referred to herein as CSP) is the name under which Clive Smith of 37 Woodlands Way, Tarporley, Cheshire CW6 0TP, trades as a sole trader.
No VAT is chargeable on the prices quoted.
Payment for these services will be exclusively through the medium of Paypal. Prints, disks and/or electronic images will be despatched on receipt of payment. In the case of restoration, remediation, retouching or other manipulation of the customer's images a proof copy, either paper or electronic, will be sent for approval before the customer is invoiced.
CSP will accept images for manipulation on the assumption that the customer either owns the copyright to the images, the images are out of copyright or the customer has the copyright owner's permission to use and manipulate the images. In the latter case the copyright owner's written consent must be sent to CSP. Emails cannot be accepted in this regard.
By accepting these terms the customer indemnifies CSP against any costs, claims, damages or losses of any kind from any action or claim brought by any third party in respect of alleged infringement of copyright.
CSP will accept images for manipulation on the assumption that the customer accepts all liability for any alleged violation of the rights to privacy of individuals appearing on the images and indemnifies CSP against any liability in this regard.
While CSP will take all reasonable care of the customer's property while in its possession it cannot accept liability for any loss or damage to such property.
This contract between CSP and the customer will be subject to English law.
